On July 13, 2016, the Ministry of Commerce issued Annual Announcement No. 31, deciding to impose anti-dumping duties on imported acrylic fibers originating in Japan, South Korea, and Turkey from July 14, 2016, for a period of 5 years.
On November 7, 2017, in response to the application of the domestic acrylic fiber industry, the Ministry of Commerce issued Annual Announcement No. 71, deciding to conduct a periodic review of dumping and dumping margins against the anti-dumping measures applicable to imported acrylic fibers originating in South Korea.
The product scope of this review investigation is imported acrylic fiber originating from South Korea. The specific description is consistent with the product description stipulated in the Ministry of Commerce Announcement No. 31 of 2016.
Based on the investigation results, the Ministry of Commerce proposed to the Tariff Commission of the State Council to implement anti-dumping measures. In accordance with Article 50 of the Anti-dumping Regulations of the People’s Republic of China and the decision of the Tariff Commission of the State Council, the relevant matters are hereby announced as follows:
1. Review ruling
The Ministry of Commerce ruled that during the review investigation period, imported acrylic fibers originating from South Korea were dumped.
2. Anti-dumping measures
According to the relevant provisions of the “Anti-dumping Regulations of the People’s Republic of China”, the Tariff Commission of the State Council decided to impose anti-dumping duties on imported acrylic fibers originating in South Korea at the following rates starting from November 7, 2018:
1. Taekwang Industrial Co., Ltd. 8.6%
(TAEKWANG INDUSTRIALCO., LTD.)
2. Other Korean companies 21.7%
(Allothers)
3. Methods of levying anti-dumping duties
Starting from November 7, 2018, import operators shall pay corresponding anti-dumping duties to the Customs of the People’s Republic of China when importing acrylic fibers originating in South Korea. Anti-dumping duties are levied ad valorem on the duty-paid price approved by the customs. The calculation formula is: anti-dumping duty amount = customs duty-paid price × anti-dumping duty rate. The value-added tax at the import stage is levied ad valorem on the basis of the customs-approved duty-paid price plus customs duties and anti-dumping duties.
IV. Administrative review and administrative litigation
According to the provisions of Article 53 of the Anti-dumping Regulations of the People’s Republic of China, if you are dissatisfied with this review decision, you may apply for administrative review in accordance with the law, or you may file a lawsuit in the People’s Court in accordance with the law.
5. This announcement will be effective from November 7, 2018
