On September 17, 2018, U.S. time, the U.S. government announced that it would impose an additional 10% import tariff on $200 billion of goods originating in China from September 24, and will increase the import tariff on January 1, 2019. The tariff rate is raised to 25%. The United States ignored China’s firm opposition and solemn representations and insisted on adopting wrong practices that violated WTO rules, seriously infringed on China’s legitimate rights and interests in accordance with WTO rules, and threatened China’s economic interests and security.
Regarding the emergency situation caused by the United States’ violation of international obligations to China’s economy, in order to defend its legitimate rights and interests, China has acted in accordance with the Foreign Trade Law of the People’s Republic of China and other laws and regulations and basic principles of international law, and in accordance with Announcement No. 63 of the Ministry of Commerce of 2018 and “Announcement of the Tariff Commission of the State Council on the Imposition of Additional Tariffs on Certain Imported Goods Originating in the United States (Second Batch)” (Tax Commission Announcement [2018] No. 6), decided to implement the Ministry of Commerce Announcement No. 63 and the Tax Commission Announcement No. 6 The goods in the list of goods subject to additional tariffs on the United States attached to Announcement No. 1 will be subject to additional tariffs starting from 12:01 on September 24, 2018. The 2493 tax items listed in Annex 1 and the 1078 tax items listed in Annex 2 will be subject to additional tariffs. A 10% tariff will be levied, and an additional 5% tariff will be levied on 974 tax items listed in Annex 3 and 662 tax items listed in Annex 4.
