The original trial of this case was filed on February 4, 2008, and the amount involved was US$4.42 million. No company responded to the lawsuit at that time. As a result of the final ruling, except for one company that received a zero tax rate, all other Chinese companies’ exports are subject to an anti-dumping tax of 6.26%. In 2011 and 2014, this case underwent two sunset reviews respectively. The first sunset review announced the continuation of taxation. After the second sunset review investigation was filed last year, our ministry got in touch with the companies involved. However, because the amount involved was only US$448,000, no company responded to the lawsuit at the time.
In this sunset review investigation, South Korea’s Ministry of Planning and Finance believed that China’s exports to South Korea did not cause any substantial damage to its oriented polyester yarn industry, so it ruled to stop taxation. At the same time, Taiwan, China, has also stopped taxing.
