On January 29, 2018, the U.S. Department of Commerce issued an announcement stating that it had made a positive preliminary anti-dumping ruling on low-melting polyester staple fiber (Low Melt Polyester Staple Fiber) imported from Taiwan and South Korea. The preliminary ruling: (1) Taiwan is involved in the case The dumping margin of Far Eastern New Century Corporation and other manufacturers/exporters is 52.00%; (2) the dumping margin of Huvis Corporation Jonan Steel Corporation, a South Korean company involved in the case, is 0.00%, and the dumping margin of Toray Chemical Korea Inc. and other manufacturers/exporters is 16.48%. This case involves products under the U.S. harmonized tariff number 5503.20.0015. The U.S. Department of Commerce is expected to make final anti-dumping rulings on the products involved in Taiwan and South Korea on June 19, 2018. The United States International Trade Commission (USITC) is expected to make a final anti-dumping industry damage ruling on the products involved in Taiwan and South Korea on August 2, 2018. If both the U.S. Department of Commerce and the U.S. International Trade Commission make a positive final ruling on this case, the U.S. Department of Commerce will issue an anti-dumping duty order on the products involved.
During the anti-dumping investigation, the U.S. Department of Commerce ruled that all South Korean companies involved except Huvis Corporation had an emergency situation in exporting large quantities of the products involved in order to avoid the possible affirmative final anti-dumping ruling. Therefore, the above-mentioned ruling against South Korea will be retroactive to 90 days before the date when the preliminary ruling on this case is published in the Federal Register. It will take effect on Korean companies involved in the case (except Huvis Corporation) that declare to the U.S. Customs.
On June 27, 2017, the American company NanYa Plastics Corporation applied to the U.S. Department of Commerce and the U.S. International Trade Commission on behalf of the U.S. domestic industry, requesting to launch an anti-dumping investigation into low-melting polyester short fibers imported from Taiwan and South Korea. On July 18, 2017, the U.S. Department of Commerce issued an announcement to launch an anti-dumping investigation into low-melting polyester short fibers imported from South Korea and Taiwan. According to U.S. statistics, the U.S. import volume of products involved in the case from Taiwan and South Korea in 2016 was approximately US$76.6 million and US$26.8 million respectively.
